With my AT&T Tilt, I swear I can actually HEAR the battery discharge when
using WiFi! ;-)

But your point is ATT doesnt allow tethering, so again how does that
make the iPhone user any worse off ? ?

Isn't that weird though, on the Tilt, wifi is the battery killer, 3G
being the savour, and EDGE in the middle.
On the iPhone it's a very different picture, wifi being the best,
followed by EDGE and finally 3G.
In all cases, if you're considered tethering, it shouldn't be a big deal
to plug the device into the laptop for power, although the Tilt will be
more power friendly since it's screen will turn off and the services can
still function.

AT&T may not be able to detect it easily or reliably enough to bill for
it.
A user using Firefox might be a dead giveaway, but if you took some
reasonable steps to hide your obvious browser identification signs, or
stuck to HTTPS, AT&T couldn't prove anything.

Several years ago, it might have been Comcast or Time Warner, had
what might have been a deep packet scan and could detect the number
of computers you had on your network, then try to upgrade the users'
account for networked connections.
